SCOTTSDALE, AZ – RSN Law and Attorney Kiri Semerdjian recently helped a client stave off an eviction proceeding during this pandemic-plagued holiday season. The client, a Covid 19-surviving tenant residing in a Phoenix apartment complex with her two young children and service animals, was recently served with eviction papers by her Landlord’s attorney. The hearing was set for three days before Christmas, or December 22, 2020.
Facing the threat of imminent eviction, the client reached out to RSN Law and on December 18, the Firm accepted the client’s case on a pro bono basis. Associate Kiri Semerdjian investigated the matter over the pre-holiday weekend by interviewing the client, reviewing the voluminous documents and researching the applicable law. Her diligence revealed the Landlord: (1) wrongfully entered the premises without advance notice, (2) refused to accept a rental payment, (3) failed to properly accept and document the emotional support animal dog paperwork, and, (4) failed to properly serve the eviction paperwork. RSN Law also learned its client properly submitted the appropriate Center for Disease Control Covid Eviction moratorium paperwork – only to be entirely disregarded by the Landlord.
Ms. Semerdjian advised the client of her rights and the landlord’s obligations (and possible violations) of the Arizona Residential Landlord and Tenant Act (A.R.S. Title 33, Chapter 10), the Fair Housing Act, (42 U.S.C. 3601 et seq.,) and other related statutes. When the Landlord learned that RSN Law and the client knew of its nefarious acts, it quickly dismissed the action on the 21st, the day before the eviction hearing.
RSN’s client is thankful and doesn’t harbor ill will towards her landlord. Instead, she states, “Even when I have been treated less than a person who may stand next to me, I see that good outweighs the bad any day. Your kindness is the kindness I will continue to show and hopefully one day it will be the kindness that helps changes someone’s life in a positive way”.
